It's hard to take someone seriously that thinks we live in a democracy. We are NOT a democracy, and that was intentional.

As Jefferson said: “A democracy is nothing more than mob rule, where fifty-one percent of the people may take away the rights of the other forty-nine.”

So it all comes down to whether or not you consider marriage a "right". If you think it is, then the courts not only should act, but MUST act to void prop 8. If you don't think it is a "right", then they shouldn't overturn it.

To say they shouldn't overturn it because it is the "will of the people" is exactly wrong. They are there to protect the rights of all individuals, not just those in the majority.
