I generally follow this line of thinking. Giving the courts unilateral decision to decide when something has changed to fall under their pervue is kind of a slippery scope.
It would allow a president who stacked the supreme court to bypass congress.
Or a govonor with lesser courts etc.
Orjust a court in general to bypass everyone else.
