The only way Apple enters the console market is through AppleTV.
And that isn't selling very well so don't hold your breath waiting for an Apple console.
As for patents, everyone is up in arms about Apple and videogames once or twice a year after new patents are discovered. Apple is constantly creating patents for various things, most of which never see the light of day.
