 Modchips are legal in Australia for the fact that regioning is considered a restriction of trade. In fact, it would be interesting to see if Nintendo did actively block modchips (and even freeloader not working) if the ACCC would take any action against them for restricting trade.

The PS3 is also another interesting area. While games are region free, blu-ray movies are not. Will be curious to see what happens in regards to that when modchips start coming out for the PS3 (although Sony might not bother chasing modchips through the Australian legal system for a second time).
