Let's clarify some things.
Sony doesn't own Blu Ray, although it's one of the main members of its consortium, BDA.
BDA decided, by members agreement, fees for devices and media, that once paid grant forfait indemnification for the patents involved. So Sony can't impose higher fees to MS, although it's true that as Sony owns a lot of Blu Ray's patents, it will receive quite an high share from the fees paid by MS.
To cut it short: if MS decides to use BD, it will indirectly pay money to Sony, but not more than any Blu Ray licensee else.
