If they were second party they wouldn't have made Layton and Inazuma >.> Third party, but have some second party games for Sony and Nintendo. Third parties can make second party games you know.

If SCE gave them a check though, the game would be second party, and they don't show games published by another company but themselves at this event, and sicne Sony publishes all their Level 5 games in every region, we won't see any Sony games at all at this event. If you want to see some Level 5 PS3 games, TGS is the way to look.

Level 5 has never developed a second party title for Nintendo.  The only title Nintendo publishes is Prof. Layton, and that's only outside of Japan.  Level 5 developed the title completely on their own, and published it on their own in Japan.
