I also made that point earlier. If by some miracle Roe v Wade is overturned, the existing state laws would decide the legality. Certain states (WA and NY) would have abortion on demand; other states (CO and CA) would allow it in certain instances; and it would be illegal in most other states.

 

In 2007, he was #1.  2008 isn't over yet so he still holds the title.

They count votes on a wide range of issues, he just missed a bunch of votes.  Complaining about how its tallied is just kind of silly.  It would be like complaining that walks count against your batting average in baseball so you could get your average a bit higher.  They tally the numbers the same way every year, both in baseball and in this rating.
