Mmm, I think you would only have grounds for a lawsuit if MS did not act in good faith and refused to replace defective consoles. It's not like knowingly selling a defective car or knowingly selling a product that is a firehazard.
Sony faced a class action lawsuit in 2002 for DRE (Disc Read Error) because they refused to fix the problem without charging the consumer at first. They eventually had to cave, but they were still pretty strict about which consoles they would and wouldn't fix. For example, if you bought a used ps2 off ebay, there was little chance that Sony would fix it.
With MS, it doesn't matter who owned it or where it came from, if its within 3 years of the date of manufacture, you spend 10 minutes on the phone, get a label for free shipping, and get your console replaced within 1 to 2 weeks. No chance or reason for a lawsuit.
