I'm pretty sure that if you download software of a pirate torrent website you can't legally have much expectations of it being malware free...
So you would have a tough time suing someone if that software actually harmed your computer.............
PS : It's like stealing a car and then sue the car-maker because you get in a car accident with it....... Maybe there is a one chance in a million you will win your lawsuit but no matter what you will still go to jail for admitting having stolen the car :P
