if you get arrested and your computer is siezed, yeah they keep it, unless you can make a case for the fact that it is a working tool or has information that cannot be replaced without damage ^^, a court order would determine if you get it back.
And nice that you say people pirate with impunity so it justifies your illegal proposal (which you seem to think you can do also with impunity putting you in the same basket as your loved pirates), but that is the wrong answer too, the right answer would be a code that sends the people's IP so that they can be found, procecuted and have a legal punishment. You can't be judge, jury and executioner.
