For something like this jail time is warranted. But if you are downloading old ROMs or some old CD that you would have to scour eBay for then I don't have any problem with downloading. Heck I've bought CD's after listening to all the songs online so I really don't think this is something these agencies need to fight so vigorously. The more you fight something like this the more the public will do it out of defiance.
Also if you download an MP3 on some file sharing program you are a law breaker but if you record songs off the radio on a tape deck or TV shows on a VCR you're not? Weird.
