Actually you'll find that that ins't illegal. It's illegal to abuse market power, but it would be awfully difficult (and by that I mean practically impossible) to prove that Microsoft has significant market power in a market where it is second by a considerable market.
Nintendo is far more likely to abuse market power at the present stage, if only because they actually have it right now.
