If Gamestop allows an employee to take a brand new game home, play it, and then the store sells it as "new", that is illegal. Taking games out of the box and storing them behind the counter for sale doesn't violate this principle as long as the customer is made aware of the process. Taking the game home and playing it before the sale, however, is definitely wrong... the game is then "used". Testing the disc once--at the store--before sale is okay... again, as long as the customer is informed concerning the process. The key word here is "testing".
I guess the argument you're trying to make is that the PS3 makes it easier for someone to be tricked into buying a used game as new. This is like saying that you borrowed your neighbor's tools without permission but it was okay because you returned them in "good as new" condition. If you were buying a toilet seat from Lowes would you want them to follow the same policy?
If I bought a "new" game from Gamestop, took it home, opened it up and found a booger on the disc, I wouldn't want to be the person working at the store when I got back there.
