Disk scratching issues are one of the stupidest things out there. The Xbox scratched alot of disks - so what? As long as they don't damage the games, its fine.
The X360 doesn't damage disks as long as its moved. Once it's moved, you've voided the way the X360 was built - not to be moved while in operation.
Even if MS lost, which is doubtful, what would they get? About $40 in free coupons for games?
