Yes, Fox was already aligned with Blu Ray. But, Warner was ready to side with HD DVD if another studio aligned with the format, and Fox was the least reliable blu ray partner. They were ready to switch to HD DVD, but were paid a sum to remain with Bluray. Warner then decided it was in their best interest to also take a payout and effectively decide the format war then and there with 4 studios out of 6
