Yes. It's coming to XBL. Rare still has a good working relationship with Nintendo (they still do DS games), and they worked something out with Nintendo.
I need to find the quote, but that's nearly verbatim (the good working relationship part).
I will go out on a ledge and say that BK will be coming out just before Banjo Three.
