That may be correct for IU, if M$ funded it, it should have the rights (of course, I don't know their degree of involvement), but for SO4, i'm 100% sure that's Squeenix's word that dictates where it may go, not counting paychecks from M$. Check this:
When asked whether the title would see release on the PlayStation 3, Square Enix producer Yoshinori Yamagishi replied "We can say that it will be released first [on the Xbox 360]. Whether we'll release it on the PS3 is undecided. We may release it, we may not."[1] Square Enix have since stated that there are "no plans" for a PS3 version,[7].
You can see that it's Squeenix who decides it, not Tri-Ace. If they decide there should be a PS3 port, there will be. Or if they want it, Squeenix themselves can port them. Afterall, it's their IP
