That case is extremely settled. Video games are not - a court could easily come down on - videos are original works and fair use for commentary reasons (Nintendo has no claim) OR substantial reproduction of content (Nintendo has full claim).


Yeah I agree with you. Which is why I have no problem with guys like Angry Joe being upset because he more than covers this with Commentary/Parody and Review in his videos. 

 

Let's Players though should be flagged and are lucky to receive any monetization.

Ironically, Youtube Poop or something like it could be protected as parody even if the owner is a Partner, or possibly video *reviewers* using content in order to create a critique. Then the question would come if a Let's Play falls under critique or merely presentation of the content. That's largely the issue, and one would think Nintendo would have less to fear from this than others. For instance, if i watched a let's play of a very story-driven game, like 999 or Heavy Rain, what incentive would i have to ever play it? A let's play of Smash U has less to fear from that, because you get little of the experience of the game through simply watching.

In this context both mean the same thing. First time I claimed it as a hypothesis, second time I claimed it as a conclusion. "Be" and "is" are both existential verbs. So there is no contradiction here. Both "he has got to be scared " and "he is scared" can be true. And one  implies the other, when considering the additional assumption of PewDiePie being a rational human being. Or do you want my language to be as rigourous as mathematical logic here?

If you mean peope making money while using the content, it can still be fair use.

Uncharted is story driven. The games you mentioned branch considerably, they are choice driven.

I also think this is a slap in the face to the YouTube channels that does focus on Nintendo game exclusively. The people who have helped and showed passion for Nintendo’s community are the ones left in the dirt the most.

Proportional drop between let's play youtubers dropping nintendo and console and handheld sales dropping or simple coincidence?
