OP: I think it could be possible with the hardware, but I don't know 100%.
This may be one of those features Ninty could give us but won't until there is demand.

Considering they devoted an entire GB of memory to the OS... Maybe. But then again the graphics card is extremily underpowered so it might affect framerates a tiney bit. Probably not enough to make a big deal though I suppose...
Considering that this is Nintendo they would declare that there is no fun in doing two things at the same time.
It's easily possible, but I doubt Nintendo bothers with it. A cool concept, but probably not enough gamer interest to make it worth updating the software.

I don't understand how one can watch netflix and play a game on the same screen and pay attention to both.... honestly, what would be the point in being able to do that other than bragging rights?
Basically it's a question of cpu power, cpu usage and memory. With a multicore cpu, and a lot of power and memory compared to what is required for netflix and vc, I think it's certainly possible.

They do that so they don't have to pay royalties to Sony, Time Warner, Philips and Toshiba. (effectibely keeping an extra $15-20 per unit sold) This is a different case; Nintendo is already utilizing Netflix.
