    It is true that the judiciary is technically non-partisan, I would argue that there still have been brief instances, and potential future instances when all 3 branches were essentially sympathetic to one party or the other.  I think this is due to the partisan manner in which Supreme Court Judges are appointed.  Just my two sense though, and like gun control, way off topic from various...
