The biggest complication I've found with this thread is how aggressive Nintendo has been as a publisher.  It's impossible not to be arbitrary at times, but as a rule, I try to look at the nature of the developer, the nature of the relationship with Nintendo, and the IP's history.  

For the purposes of this thread, I am inclined to accept both as third party since they were made by Platinum Games and Marvelous, which are both fully independent developers.  It's something we could re-assess if there's strong feelings about it here, or if it comes out that those studios were simply developing on contract for Nintendo.  In other words, I currently see it as being more like Square Enix and Octopath Traveler rather than Koei Tecmo and Smash.
