And not to mention this doesn't even ban your LIVE account, just your console so you can redownload everything or keep using your LIVE account on another console.

Agreed. Especially about the warranty issue. Do you know how many companies let you crack open their product, tinker with it, send it out to someone now officially qualified to work on it, and THEN respect a warranty? There's virtually no product in ANY category that allows that.
As I read that article, it was abundantly clear that the writer didn't like Microsoft, and used semantics and supposition to make banning pirates somehow seem bad.

As for the last sentence in your post. What I was asking is that if MS sees that your seal is broken and that repair work was done on your 360 by someone other than them, would they send you back a banned console? The article seems to suggest that they would. I would hope that they wouldn't do something like that though. I remember changing the case on my PS2 and installing a Crystal Chip in it. I completely forgot about the chip and sent my PS2 into Sony for repairs. They sent back my PS2 in the custom case but removed the chip, which was understandable. Luckily though for me they were dumb and the chip was sent back along with my console. |
There's actually a way for MS to know about that. If you call them to get a repair, you have to give your information and the serial number of your console, only then they tell you if you are bound to pay for the repair. Say you decide not to, repair it yourself, and go on live again, they can track your console online, and since the console is marked has "unrepaired" in their system they can proove you have breached the ToU and ban you.

I saw a thread once on the Offical forum where a guy got banned for changing the fans on his 360, and the mod replying that unless mods where external decals, paintjobs or modification he was entitled to be banned.
Here are the ToU of XboxLive regarding specific modifications.
