There are tons of adult games that doesn't have a M-rating. I meant just how many kids do you see playing a E-rated game like Heart of Iron 3?

I know Nintendo owns a patent on something to do with the gameplay, but I am not sure it is a definite that they own the IP.

It's complicated for 3 reasons.  First Nintendo is the one who has the name "Eternal Darkness" trademarked.  Meaning the property is actually a Nintendo property... for the most part.  Second, Nintendo has the patent for the gameplay setup in the game... namely the sanity meter.  Finally, Nintendo still owns a hefty amount of stock in Silicon Knight.  Not a majority but definitely quite a strong share. 

So it is complicated because to make a sequel Nintendo would have to be behind it.  I'm not so sure Nintendo would want to continue the series considering the first sold poorly or maybe Silicon Knights doesn't want to continue it on Nintendo platforms.  I have no idea what the actual trouble is but like Goldeneye 007 I can imagine it is quite complicated.



Nintendo makes games, obviously. They have their own 1st party studios, like EAD, SPD, NST, etc all which make SW and help make the HW sometimes, so Nintendo does make games.

Also, not everything published by a company means they own the rights, for example Nintendo doesn't make Fatal Frame nor own the franchise, they just published it.

Nintendo create/buy studios to make games. While they are owned by Nintendo, they can be thought of as semi-independent. 'Nintendo' in a general term describes all of these. What I meant with that though, was, Nintendo isn't a developer though it owns developing studios. As long as a game is published as well as owned by Nintendo, though, it is First Party and therefore it could be considered, "made" by Nintendo.

As for your second point, I didn't realize somebody mentioned that every game published by a company was owned by them.

@sc: Nintendo makes their games, they don't "own" studios save for the second party ones. Going by your definition, Nintendo would only be an impersonal entity. If they don't make their games, then they don't make their consoles either. Nintendo is a company that makes both HW and SW. Nintendo doesn't own the studios that make HW and SW, they make it themselves.

These studios are part of Nintendo and they will die if Nintendo dies, there's no such thing as a studio made and owned by company, but which products aren't made by the company. Nintendo develops games.

But I guess we are arguing over a technicism, which is not worth arguing about. I get your point though, but I disagree with how you interpret this.
