The problem is that being able to give proof that you have the technical ability/knowledge to be able to make it is an extremely grey area - the only straight non-grey way to do it would be for the government to finance building a prototype of every registered patent. 

Both patents and trademarks have been abused for decades, my uncle who used to work for a big-name parfum (you know, fancy aromatic water) manufacturer used to snicker when he mentioned that due to the way people have spammed the trademark registry they'd need to pay for the trademark of every new product they'd release.
