I don't see how they could sue them. There are still enough differences in controllers so I doubt there would be any point. And PS3 controller and 360 controller also have almost identical basic layout. The only difference are that left analog stick is in different place. There is practically no other difference in layout of the controllers. They have same amount of buttons and they are in same positions. Sure, MS and Sony have named the buttons differently but those are still same buttons.
There is actually at least as much design difference between 360 and OnLive controllers as there are between 360 and PS3 controllers. Actually Sony could sue MS for using their design and probably Sony could be sued by Nintendo.
