I think to some degree this is Silicon Knights' business plan catching up with them.
The company seems to put at least two years effot into each game and releases about one at a time. This leaves relatively little room for error, and UE3 problems apparently caused a big error.
I'm not really sure which side of the lawsuit I'm on. Even people in the industry seem to have split comments on UE3's quality and timeliness...but I don't think Silicon Knights is pursuing this out of nowhere, either.
