I think MS would be mad to pursue this. Yeah he broke his NDA, but so did the guy who spilled the beans on tobacco companies. If he gets viewed as a whistle blower - i.e. he broke rules and cover for the right reasons - then MS is only going to look like a guilt party trying to hide something by throwing its weight around.
Right now MS best view is to take the high ground, explain that due to his actions they couldn't retain him in employment but take no further action against him.
Try to be reasonable... its easier than you think...
