I don't see how this is not a case nor do I see why anyone should have a problem with it being a case. If someone comes into your building takes pictures of it and then distributes the pictures in a manner that makes them profit and is what you consider a bad representation of what goes on in your building what's the big deal about asking them to stop. If you read the article never does it say the Church is asking for any money they say they are in an area that has high gun crime already and they'd really like it if games weren't made depicting their church as a possible gun fight location. From what I understand they just want an apology as they were likely either not asked to have their church in the game or if were denied the request if it is the latter they definetly have a case. While I don't believe they are going to get the games removed from shelves I don't believe it is to much to ask for the game to be produced in the furture at least with a different name on the church as this likely wouldn't of been noticed unless they made direct referance to what church it was.

That's the way I feel as well. I never said that this was a good suit. Just there might be some legal merit for it. Fanboys in their rage put their own spin on what I said.

Just because you allow guests onto your property does not make it public domain. You can't go into a building and publish photographs of the inside without the owners permission.

Is it illegal to find the old version of the church ie 1954 look and recreate it. The copyright if there is one cant legal stand that long. The outside shell shouldnt be able to be argued against if so GTA4 is screwed since they recreated all of New York and they didnt ask permission. Even if they call each place a different name they are using the exact building structure for each building.


Good point, Ssj, but this isn't what I understand the developers did. My understanding -- correct me if I'm wrong -- is that they went inside the Church, took pictures of it, then recreated it in the game. Again, If I'm wrong, please correct me.

And Gballzack: no, the church is not public domain. It can't be. It's owned by the Church of England. Separation of Church and State is applicable there too :p

 

 does anyone have a current picture of the inside of the church? If so I can compare it to the game right now. I beat the game so I can go to any map I want.

Well, I disagree with you and it has nothing to do with fanboys or anything and everything to do with the 
protection of artistic license.  For example, if the Louvre objects to someone writing a work of fiction
about a killer albino prancing about, tough luck.



Isn't the Lourve a public institution, not a private entity? If so, the laws regarding public spaces are different from private spaces.

That was just an example. If you want to stick to churches, there was a hunchback that used to hang out at Notre Dame Cathedral.



I'm just looking at it from a legal stand point.

Does the owner of a private space have any rights when another person creates a photorealistic representation of that space and uses it for their own commercial purposes? All I'm saying is it's possible.

Oh yeah.....I can easily see how that could be confused with reality. See, stupid people like this are the reason big companies have to do silly stuff like embroid the words "HOT" on every coffee cup before handing them to customers. People are just stupid as all hell.



For the record I hate the copyright and patent system. It's completely screwed up. Some people have completely misconstrued my remarks as anti-Sony, which they are not. I have only said that that there might be some legal merit to the case. If that's offends anyone, they should really develop a thicker skin.
