Hard to say, the CMA did issue a prohibition for MS to purchase ABK completely or partially but IDK if that's as a direct result of their block, meaning the ongoing CAT appeal also challenges this injunction and prevents it to become effective until the resolution of the case or not.
Other than that closing over ongoing processes is normally accepted with a hold separate agreement which MS actually intends to do anyway.
I have a feeling that (if the CMA injunction is not actually effective) MS is gonna merge on the last day of their original agreement stating no regulations have proven wrongdoing in the more than adequate time window they've given them (the CAT appeal essentially putting a hold on the CMA decision).
Microsoft says its attention turns to the UK regarding the Activision acquisition: "While we ultimately disagree with the CMA’s concerns, we are considering how the transaction might be modified in order to address those concerns in a way that is acceptable to the CMA"
