Judge Corley again cut something short ("next question") by clarifying Professor Carlton read the contract Microsoft offered to Sony, even if it's not in the appendix of his report.

We all know that Activision got special terms from Sony for CoD (publisher-friendlier than otherwise).

Microsoft's expert witness basically compared the offer to Sony for CoD to the other CoD contracts and said they're similar but the FTC is trying to say he didn't read the Ghostwire Tokyo so he can't say it's like other contracts (but his comparison was between CoD contracts and we already know CoD has a unique contract compared to other videogames).
His response that "he didn't think it was relevant" because it shouldn't be, Lol. Ghostwire Tokyo doesn't and never had the same contract as CoD.
The FTC is still nowhere near getting an injunction, but based on how this examination of Professor Carlton has gone so far, it's possible that Judge Corley is now skeptical of parts of his expert testimony. That still wouldn't make a difference in the end.

All that Microsoft needs to do is identify issues with the FTC's economic expert testimony. I believe that was already achieved just through the cross-examination of the FTC's expert. Plus, Dr. Bailey's testimony is likely to be deemed reliable and relevant.

Feels like FTC just tried to say Ubitus, Boosteroid, etc. Are irrelevant because they're small companies located in Taiwan, Ukraine, as if they only care about protecting large companies, Lol. And she's acting like people will have to use Ukrainian servers, as if Boosteroid won't expand and have local servers too, Wtf, Lol. FTC doesn't know about datacentres.

Professor Carlton explains that Professor Lee's "share" model is actually a demand model. What matters according to Professor Carlton is not make share but a change in Xbox sales as a result of hypothetical foreclosure.
