MS expert sounds like she has a ton of data, shame it's all in the court-room and we can't see it
Shots fired at Dr Lee. "You don't have to look at some model to tell what's going on."
With actual data*
Last edited by Ryuu96 - on 28 June 2023Judge Corley now wants to hear from Dr. Bailey more specifically about switching between consoles and gaming PCs. Judge Corley notes that the avialability of the same games on both types of platforms enables switching.

Dr. Bailey says maybe some would go out and buy a PC (to switch from consoles) but the more common scenario is that they already have a PC and then use it to play certain games.

A chart here shows Xbox Console and Cloud Gaming HJours, 2019-2023, obviously a COVID peak for the console. There's a green line for Xbox and it looks like a mountain range. The orange line for cloud gaming hours is barely above the X axis!

Cloud Gaming hours less than 1% of console gaming hours
Her data backs up Bond's testimony that people use Cloud Gaming to play a game whilst it's downloading.
I can't hear the FTC's lawyer but
Microsoft Expert Witness: "I disagree. If a customer is using a console to access the cloud then by definition they have a console."
They must have asked a really stupid question.
FTC wanted Dr. Bailey to confirm that an antitrust product market is the set of products to which people could turn in the event of a price increase. Dr. Bailey says it's one consideration, not the only one.

Q If someone is using a console to access the cloud, you view that as substitution?
— Derek Strickland (@DeekeTweak) June 28, 2023
THere's nothing else you do with a console. The console is no good without the game. If you have a console you have a console to play games on it. When I can see Xbox gamers accessing the cloud…
"FTC brings up taco bells in washington and san francisco would have a similar menu. That similarity doesnt mean they're in the same geographical markets."
