With the merger, Lee says it will not be on PS "with certainty". Likelihood is lower.

Microsoft lawyer stresses comparison is not whether it's more or less likely, but whether it's likely.

Judge Corley now also got Lee to confirm that he does not say CoD is likely to be removed from the PS -- just that it's more likely to happen after the merger than otherwise, and that he thinks there'll be some foreclosure of Activision content overall.

Judge Corley points out that there are many games and it's impossible to predict which future games will be popular. And says that by that standard any acquisition of a game publisher would be anticompetitive. "Don't quite understand what you're saying" she says.
