Not sure if this applies to In-game dashboards, but Sony will have to find a loop hole if they don't want to get sued.

claim 1 (of 21) :

1. A method comprising:

receiving a request to launch a game in a gaming system;determining whether the game has a user-associated soundtrack;if the game has a user-associated soundtrack:launching the game; andplaying the user-associated soundtrack;if the game does not have a user-associated soundtrack:allowing a user of the gaming system to select a soundtrack to play while the game is executed; andplaying a default soundtrack if the user of the gaming system does not select a soundtrack.

this patent wont hold up in court. Sony has nothing to worry about. Sony already has some in-game music in games.

If you start a song first and then play the game that is different and thus not covered by this patent.
