I'm not sure what the exact context was of what they said at E3 was, but I suspect it was referring to the most recent week when Animal Crossing had been released. In the first five months of the year, in the US, the 3DS was down. Jan/Feb were down by a fairly significant margin. Mar/May were up by a tiny amount (500-5,000 units). April we didn't get a concrete number, but at best it was up 3k, at worst it was down 24k.
Going beyond the scope of E3, June was up significantly, and July was also up though not by a huge amount. Through the first seven months, the 3DS is down in the US. There is a pretty strong likelihood that it will be down in August. In short, it is unlikely that the 3DS is currently or for the year up in North America.
Regardless, your original statement wasn't about North America, but about the health of Nintendo as a company. Why is the North American performance any more relevant than the performance of the 3DS in Japan where it is down this year? Especially considering in the first 6 months of 2012 Nintendo shipped over 55% more units to Japan than they have to the whole world outside of Japan in the first six months of this year.
