Could you please name a specific action that directly affected Sony's decision to give Geohot an ultimatum for Geohot to accept to Sony's advantage?  Source?

I said it looks like it to the uninformed -___-

And how in your eyes did it look like it?  Could you please name some specific examples?  Or are you just making a general sweeping statement of a guess?

is that your baby? omg so cute that I melted!

What do you think it will mean on the long run?

Nothing.

Sony probably realized they couldn't win and were afraid of what a court ruling against them would do.

The hack is still out there.

And that's really it.

This accomplished nothing other then Sony trying to threaten people from doing legal things it didn't want them to do.

Maybe a hacker or two decides to not hack Sony products now?

Doubt it.

From the sound of it, the whole thing cost Hotz nothing, other then the fact that he can't distribute something that is already all over the internet.

Whole thing was a waste of time, and sony's money.  Surprised Hotz didn't ride it out like he did with the Iphone though.

My guess is he was running low on legal funds and wasn't sure if he could get a second batch.

I wish this had been tested in court. It would have been groundbreaking to have a ruling that Sony has no power over the machine's software after they sell it (which is the only result that wouldn't produce chaos).

Same. Now we're gonna see some other fucked up company trying to act like what I bought is their property.

If you remember, APple tried to push off jailbreaking as illegal and they got screwed by that, so the sooner another retard company comes along and gets slammed by the courts for their shit business practices, the better.

Though, this action has never been about removing the right of people to modify what they own.

Nope.  If you look at the charges, according to SCEA THEY own your PS3.  As Hotz was being sued for "Illegally accessing one of SCEA's PS3s."  (Aka his own.)

It wasn't about modifying what you own.  It was about whether or not you own a PS3 when you buy it.

1. Geohot walked away without any problems m

2. Sony spent over a million dollars trying to prosecute him

3. Sony lost a customer(who bought quite a few PS3s)

yes, Sony definitely won

According to the injunction, the injunction itself applies to every hacker that Geohotz has contact with.

I'm guessing that the subpeona for all those IPs, personal information, etc etc has something to do with the scope of that victory.

A private settlement can't make a ruling for anyone but the parties involved. Nor can they used any of collected data beyond the scope of what the courts allowed, which was only to establish location of alleged activity.

i texted a friend of mine who is a lawyer and he said that while it is "not likely" that this settlement can have a "precedential value" there are "exceptions".    Then he told me to research "judicata", "collateral estappel" and "judicial estoppel".

I have no clue what that means but i'm going to look into it a bit.

also, this thread is epic fun. xD

Collateral Estappel is when a case is decided.

Both though basically state that once a matter is settled it can't be brought up again.  Same with Judicatta, but that's for settlements.

Judicial Estrappel basically states that you can't take a different position in a case have taken in another case.

Which may actually explain why sony settled.  Since they were taking opposite positions in the Other OS lawsuit and the Hotz Lawsuit.

They claimed vs Hotz that they were responsible for everything involving PS3s and owned your PS3s.  While in other OS, they were claiming that all complaints had to got to Sony the parent company.

Had both trials gone to court, they probably would of lost which every one reached judgement last, and the lawyers could immediatly site Judicial Estrappel.  Either causing the Hotz case to be desmissed (and damages paid) or the Other OS lawsuit to be lost.

Reading the settlement that's been released.  This really did cost Hotz nothing.  He only gets penalized if he re-releases what's already out there.   Hell, sony even consented to try him in NJ if he gets tried for anything else.  He didn't even have to admit he did anything wrong.

Heck.  They even dismissed the charges agaisnt Cantero and Sven Peter.

This. And him being banned from buying a SCEA product doesn't stop him from buying a Sony product, so a boycott of SONY products on his part is legitimate. He's a hacker, hackers don't just stop - they love a challenge. I knew there was more up his sleeve.

I don't see how boycotting a product will help his hacking skills.  But if he really needs a challenge, there's always mountain climbing.

Oh no, now Sony will drop to dead last in sales, even behind the PSP.  Oh wait, no it won't.  Sony's fine.

Edit:  Lol, according to that article he stated he won in court.  Oh man, this guy is arrogant and blinded by his own ego.  We'll see who won if it comes out that he had anything to do with another hack.
