This is different case to either of those scenarios I'd say.  Not that I think it's an actual issue myself, although I can see it drawing some unwanted attention.

Yes because my position assumed a start point without anything already in your house.  Hence I had no idea what you meant.  Now, if you already have webcams, etc. in place then clearly suddenly grumbling about Kinect is a bit redundant.

I was really think of the new audience MS is targeting, who presumerably don't have 360s already and might be worried about having a webcam in their living room.

I can see where you're coming from but we're thinking of different start points to the arguement.

Which if you don't own 360 you won't have, correct?  Read my post again, it's perfectly clear.  I was talking about the possible reaction of NON-console owners who might be worried (I don't think they would myself) about buying 360/Kinect bundle if there were concerns around this.

I therefore was thrown by comments specific to existing owners.

Any issue here would clearly be with market perception for all the new people MS want to draw in with Kinect, not someone who's been hooked up for 3 years to Live.

No, not really. We're in a thread about Kinect. The natural thing to assume would be that he was speaking of headsets and cameras already belonging to an Xbox owner. Alternatively, if you are to assume that we're speaking exclusively about people who do not own a gaming console with camera capabilities, then it would not be unreasonable to assume those consumers may already have a webcam of some sort, or a laptop with one built in. Anything from a webcam to a microphone could "listen in" on someone, connected to a computer or otherwise.

If you are speaking of people who don't own an Eyetoy, Kinect, Vision cam, blue-tooth headset(i.e. PSN) WiiSpeak, webcam, or other way of displaying images via digital or audio input, then yes they could choose to be paranoid. They also may want to begin thinking of buying a laptop, or at the very least, a microphone.

It wouldn't be an invasion of privacy because in order for the police to get a hold of the videos they would have to get a warrant and they can't get a warrant without probable cause, meaning, they already have good evidence that the person is guilty.  This is how the justice system works, cops can't just barge in and invade privacy. 

Edit:  Also, there is no way that MS could even begin to record every video of people chatting, so really the only way that video could be recorder is if someone complains about a user so MS/authorities look into.  It's to keep people from doing illegal stuff.
