Colorado couple threatens to sue cops for letting marijuana plants go to pot

FORT COLLINS, Colorado - A Colorado couple whose medical-marijuana plants were seized are threatening to sue authorities because the plants were returned dead.

Lawyer Brian Vicente says police seized 39 live marijuana plants from Jim and Lisa Masters in August 2006 and arrested them on drug charges.

The couple say they were using the plants for medical purposes and providing marijuana to several patients who were licensed to get it.

The narcotics charges against the Masters were dropped in June and the plants were returned to them Monday but dead.

The couple's lawyers say the plants might be worth more than 100 thousand dollars.

Police spokeswoman Rita Davis says the department didn't have to care for the plants because the couple did not have documentation to show the plants were legal.

so were they licensed to give(sell) drugs away? You cant just grow and giveaway(sell) drugs without a license, thats illegal. -_-
If the couple arent pharmacists or doctors then theyre in trouble.

iclim4: Note that the plants weren't actually illegal, they just said they didn't have documentation that they were legal. In the end, the plants clearly were legal, seeing as if they were distributing illegally... the charges likely wouldn't be dropped. USA has a hard on for wasting taxpayer money with the war on drugs.

Let me give you a horrible example - You buy a rarely legal, but legal for you dog, police say "No", take it away, don't take care of it because it wasn't liscenced until it turns out you really have it legitemately and now you have a dead dog. In this case, consider Marijuanna medication that can't be left in a moist room, but the cops took it and left them in the shower.

Some may agree or disagree that it's hard for the police to take care of things taken as evidence, but if it is entirely legal for them to take and return evidence with 100% damage and not be responsible, that's 100% fucked up, particularly with no charges pressed. With charges pressed and illegal possession, then destroying it is probably fine.

Shams - Cops don't keep a live stash, but they do probably have a couple hundred K of already harvested stuff.
