There was no requirement for popular vote at all. In the first few presidential elections most states had state legislators pick the electors; the majority of states would continue this through 1812 and a good portion did it through 1824 & 8.
Alleged vote fixing of 2000 and this are two different things. Of course if Al Gore would have won he would have already killed Bin Laden himself with his bare hands.
