It probably has to do with the difficulties in policing Xbox Live content. A child can buy a points card and purchase whatever their heart desires on XBLA unless parental controls are activated. At least I assume parental controls would restrict certain marketplace content. I don't know personally whether they do. In retail outlets, the employees can and have to police it.
