 Why drive down to your local retailer and ask them to replace it when you could call your lawyer and start a multimillion dollar lawsuit? I mean, a phone call is way easier than a drive, innit?

endurance: Do you have to continuously clog up every thread on the forum by posting from 5 to 7 one line comments in a row? I mean you could just fit them in a single post with a tiny bit of planning, and it's not like every single one of them contains some critical information you need to share with us.

He's not suing for millions personally. It's a class-action lawsuit, meaning there could be potentially thousands of "plaintiffs." He's suing on behalf of a group of people, my guess would be that he's asking for either their money back, or new copies of Halo 3. It would be foolish for him to sue Microsoft for $5 million just because his one copy of the game had problems, as I don't think anybody could be damaged $5 million dollars worth by a video game... Unless perhaps it killed his parents.

Either way, I think it would make more sense to just ask for a new copy of the game, or perhaps a patch (Microsoft apparently is aware of the issue, which leads me to believe they're working on one). Class action lawsuits work better when a large amount of people have actually suffered some sort of physical harm, not a technical defect that the company would seem to be all to happy to replace for them (as evidenced by their free game of Halo 3 when you buy an Xbox promotion). The lawsuit seems to be a pretty poor plan of action, but maybe the guy's just trying to bring some attention to it. Afterall, suing a huge company over the biggest media event ever has gotta make headlines somewhere.

 i think all versions had isses due to Microsoft's packaging machines not placing the disks in correctly making it so tat all the discs got scratched during shipping.
