The best problem i have ever seen with a 360 is at my friends house when the 360 told me that the disc needs to be played on a 360, it said this in about 10 different languages. I'm not sure the exact words, but that is pretty much what it said.



I want to hear his attorneys arguments.

@ssj12 I don't think that the Legendary Edition was the one with the scratches,but the Limited Edition. EDIT mrstickball was faster.

This kind of stuff makes me sick to no end. People can't just take responsibility anymore for anything. Chances are he either scratched it, or its just an error. MS released a statement that they would replace all scratched Halo discs the 2nd day it was out. Amazing how he is having problems with it now, almost 2 months later. It is just like the old lady that won $1million from McDonalds for spilling hot coffee on herself. Wasn't her fault, because you know, they didn't warn her that the coffee was going to be hot. Who the hell drinks hot coffee?? It really makes you wonder what kind of judges we have in our legal system that would even listen to frivolous cases like these. What is the world coming to? I swear, no one does anything to help themselves or advance their placement in society, they are never responsible for anything bad that happens in their lives, and expect everything to be handed to them by the government or any number of corporations without having to do a god damn thing in return.

 I don't get why this guy thinks he is entitled to $5mill for buying a $60 game that had a disc error, one that was well known about and happened to others, and was offered to be replaced for free by manufacturer the day after it became apparant to the media and consumers.

I agree with the lawsuit because all the claims are legit. I was not affected by this but Microsoft has stated knowledge of the problem and has shown absolutely no passion in fixing the problem.

The lawsuit is not 5m for just him so I see no harm in taking Microsoft to court. They really have been lazy about it and if you put a product on shelves, and charge as much as they do, then you expect product quality and in the case of poor quality, at least decent customer service.

Normally, I would disagree with a complaint like this but Microsoft really should have this sorted out and should have already compensated those gamers that lost out on their original copies. Especially us collectors whom really care about stuff like that.

At any rate, he will probably lose but a class action suit is a great way to wake up publishers about quality in handling.

I saw a blurb on a TMZ episode that claimed "Halo 3 breaks your XBox" and mentioned that a class action lawsuit was filed from California. I am guessing it is the same case. The multimillions is to compensate everyone with a problem. Of course these things just end up with richer lawyers but who's counting. I had assume that MS had escape the RROD bad press but if this catches fire again as the US media is apt to do it could be big problems for MS.



Final* Word on Game Delays:

The game will not be any better or include more content then planned. Any commnets that say so are just PR hogwash to make you feel better for having to wait.

Delays are due to lack of proper resources, skill, or adequate planning by the developer.

Do be thankful that they have enough respect for you to delay the game and maintain its intended level of quality.

A Californian gamer has filed a class action lawsuit demanding damages in excess of $5m against Microsoft and software developer Bungie, all because his copy of Halo 3 allegedly doesn’t work properly.


UK gamers have complained of an unreadable error, when playing Halo 3

Whereas most gamers would simply take a damaged disc back to the shop, plaintiff Randy Nunez decided to become a champion for gamers’ rights. He's taking the two companies to court to battle it out on behalf of any similarly affected California consumers.

Nunez’s class action laqsuite, which was filed with the US District Court for Southern California earlier this month, alleges that the game consistently causes the Xbox 360 to “crash, freeze or lock up” while being played.

He also claimed that Microsoft and Bungie have “failed to recall” Halo 3 or remedy this alleged failure to function, despite “mounting consumer complaints and inquiries concerning this operational flaw”.

Microsoft admitted to Register Hardware last month that it’s aware of a problem which stops Halo 3 from loading correctly, but it refused to reveal the cause.

At the time, we spoke to several similarly affected gamers, who each gave us a slightly different account of the problem. However, the common complaint trait was the appearance of a message on screen saying the disc was unreadable or that it couldn’t be loaded.
