Nothing personal at all to you, Zucas, but everyone:

Please NEVER buy used games at Gamestop if a new copy is also available. If the savings were significant I'd see the point, but $5.00? Spend the extra cash and give the money to the developer/publisher who deserves it. Buying the game used only saves you five bucks, with the majority going to Gamestop.

Actually, found a bigger version of the cover and the guy is shit out of luck.

It clearly states it's a one-time use code and it's only available with a full retail purchase before April 30th.

The most surprising thing about this is Gamestop only makes about 20% of its revenue from used games. They can definitely survive without whoring used games like they do. But digital downloads is their biggest problem.

Revenue and profit are two entirely different things.

Yeah it may only be 20% of revenue but it could provide 80% of profits.

The success of the case will come down to how much of this is buyer beware. Can it be shown that Gamestop was in any way implying the DLC was still free in used copies? If not, then what are Gamestop's responsibility for explicitly disclosing that the DLC is not free for used copies? What is a retailer's duty of care in this respect? If someone is selling DA:O on E-bay are they required to disclose that the available DLC must be paid for separately? Does a retailer have a higher legal obligation for transparency than a private seller?

Different countries have different laws about this sort of stuff. It's not clear what liability Gamestop will have, but reputationally its pretty poor form.

Is obama running this thread??? Sounds like your crying because Gamestop is a big company. I love Gamestop!! It gives me the chance to buy EA games used and EA dosent get one red cent!!! With a 7 day return policy on used games, whats not to love!!??
I can tell most of you are very young by this thread. Mommy and daddy buying all your games so you dont care price and return policy. you all need to learn the value of a dollar. Start buying your own games and I think you'll have a positive outlook on Gamestop

Pretty much.

When a used anything dealer makes a sale, the dealer is obligated provide full disclosure on the merchandise to the best of their knowledge.  If the box hadn't specifically said "retail version" then Gamestop would have been in the red for failing to disclose that the bonus wasn't included in the used version (it is reasonable to believe that a used game dealer would be aware of these things).

As it stands, Gamestop just has to say "We sell used games, not retail games, and here's what the box says."
