I can't speak for anywhere else but the ESRB has nothing to do with if a game's content can be legally shown.  It's an arbitrary, self-regulatory system, not a government system.  

Regardless, the ESRB's function is to determine if the game's content is okay to be shown or not. In addition, what you said is only partially true. In Canada, the government enforces ESRB ratings in a handful of its provinces.
