As I recall, the Nintendo official didn't say you couldn't, only that it "wasn't recommended."
Perhaps what he meant is that some SD cards are sluggish and unreliable, so your milage may vary, and Nintendo isn't going to guarantee a good experience if they can't guarantee reliable hardware.
