The trademark, but not the copyright. Copyright takes 70 years to expire. Basically what this means is that Nintendo could use the Scalebound name since it is no longer trademarked, but MS has rights to the characters, story, and art assets that Platinum already developed. Nintendo and Platinum would need to start over from scratch and make significant changes, unless of course Alanah is right and Platinum successfully managed to buy the copyright back from MS. 

If Platinum or Nintendo successfully applied for the Scalebound trademark , would it even  be worthwhile  buying the IP from Ms would gaining  the use of the  story and characters be enough since you would think they wouldn't  use any of those art assets.
