Now that the Console SLC is gone, we can look back at CMA's only remaining complaint and how it now looks.

These are the "Cloud Gaming" providers mentioned by the CMA and how things now stack up as CMA's only complaint.

Support

  1. Nvidia GeForce Now = Supports the Deal & 10 Year Agreement.
  2. Boosteroid = Supports the Deal & 10 Year Agreement.
  3. Ubitus = Supports the Deal & 10 Year Agreement.

Against

  1. PlayStation Now = Against the Deal & No Offer?
  2. Google Stadia = Against the Deal but a Dead Service.

Excluded by CMA

  1. Facebook Gaming = Considered Materially Different to xCloud.
  2. Nintendo Switch Online = Considered Materially Different to xCloud.
  3. Antstream Arcade = Retro Titles Only.

Not Important.

  1. Shadow = Doesn't Require a Deal.
  2. GameStream = Owned by Nvidia & Shutting Down.

Unknown

  1. Utomik
  2. Blacknut
  3. Wiztivi
  4. Amazon Luna

Amazon is a curious one because they've never expressed publicly or privately being against the deal, they barely even try with their own Luna service and despite CMA listing them, I think Amazon really doesn't give a shit about Microsoft acquiring Activision-Blizzard...Even in their response to CADE it basically had an aura of "we really don't care" Lol. I'd list Amazon as either "not caring" or neutral.

Honestly Google's thoughts should be irrelevant, they came in a market with an awful business model, barely tried to compete and then left the market, then tried to blame Microsoft for their own pathetic failures, a trillion dollar company trying to imply it couldn't compete with another trillion dollar company is laughably pathetic.

Lets crack those deals out with Utomik, Blacknut and Wiztivi and get this over with.

Idas Said:

If I‘m not mistaken, the last time that the CMA revised its provisional findings was in February 2020, with Bauer Media Group. Bauer was also the last time were behavioural remedies were accepted :P

This bit from the addendum published today is also very interesting:

In addition, any interested person is invited to provide the Inquiry Group with their views in writing as to the impact of these addendum provisional findings on the appropriateness of the remedies proposed in the Notice of Possible Remedies published on the case page on 8 February 2023.

The CMA wants feedback about the possible impact of this change on the remedies originally proposed. :P

Yes, not doubt that today is a major turning point for this case.

---

CMA's Accepted Behavioural Remedies with Bauer Media Group.

A group of independent panel members (the Group) at the Competition and Markets Authority (CMA) investigated the Merger and published its Final Report on 12 March 2020. In its Final Report, the Group concluded that: the Acquisitions, as a result of each of: (1) Bauer's acquisition of the ability to exercise material influence over FRS; and (2) its acquisition of a large proportion of FRS' customers (by share of business), have resulted, or may be expected to result, in an SLC in the market for the supply of representation for national advertising to independent radio stations in the UK.

However, in the specifics of this case, the CMA felt that requiring a divestment would have involved certain risks and therefore preferred to go down a route of requiring Bauer to provide sales representation services to independent radio stations on the same terms as they received previously, for 10 years.

The Group concluded that a behavioural remedy requiring Bauer to provide representation services to independent radio stations on at least the same or better terms than customers currently have with FRS was the least onerous effective remedy, and one which is proportionate to the SLC and the adverse effects likely to arise from it

Former Obsidian writer/designer Chris Avellone has been exonerated after his 2 sexual assault accusers posted a full retraction of their claims in an out of court settlement where Chris also got a 7 figure payment from them including a refund of all of his attorney fees:

Lol, I'm not sure if all of those are Backwards Compatible and/or available on Xbox One/Series but it should be close enough.

I doubt we'll see the licenses on Game Pass, I'd think they may be too much effort than they're worth.

Yeah there's quite some stuff on there that won't be on Game Pass. I would also add THPS5 which is delisted (thankfully...), Sekiro is a) no Activision IP and b) only published by Activision in certain parts of the world, Overwatch 1 is no more and 2 is already F2P.
