Would make no sense for Nintendo to take down games that look like Super Mario Bros on a game that is made to look just like that =p (sure streams on youtube would be taken away during that time Nintendo was being very strict against it).

I said this was going to happen, and some people (not necessarily on these specific forums) swore up and down it was ceative freedom and they could not do anything about it. Well I guess people only choose to believe what they want, then complain when they realize what they want =/= reality. 🤷‍♂️

Not having "legal grounds" is not the same as not having a legal challenge.  Nintendo scares those people into submission, because they can't afford the legal battle.   That may well be the case here as well, but it is not as obvious. 

It may also be arguable that this use of Mario is helping to sell the game.
