They'll get laughed at by IW contracts / legal dept - if thewy ever gave a **** about that domain name that is.

it's just a way to promote their own site. i doubt you could sue them over name especially that one.
i could create modernwarfare.net site about you know modern warfare not as a game fan site but, as military fan site and activision couldn't sue me no matter how.
also modernwarfare4.com owners are basically screwed cause not only they have to pay for the server for atleast 4 years, but also there is high probability that activision will go Call of Duty way and there won't be MW3, MW4, MW5 etc but, MW:Subtitle.

Actually, Activision has the phrase trademarked under the descriptive category which is protectable under the law.

They can either file a formal complaint under the ICANN Uniform Dispute Resolution Policy where an arbitration panel will decide who gets the domain name.  Based on the guidelines in their policy, Actisivion will win thanks to their trademark.

And the Anticybersquatting Consumer Protection Act allows them to file a complete lawsuit which would not only grant them the domain name but award them damages up to $100,000.

 

So I don't think you really want to go around making a modern warfare website because Activision would have full rights to take it way via ICANN or worse, sue you for damages in the courts.

But this is blackmail... that's stupid.. They should have made a fansite.. and name it Modern Warfare 4 ever.. and then say they forget to add ever in the url.. then they had a chance to get something..

But you are wrong with the ICAAN and ACP act.. that's only for US cases.. it seems that the boys are in the UK so they will have to go to the WIPO..
And with the workspeed of the WIPO that will be solved when Modern Warfare 6 is out.... xD

iw will probably have a different setting by mw4, space maybe?!



WIPO is an authorized ICANN arbitration board however they can still file a UDRP complaint with ICANN regardless of registration nation.

I noted the ACPA separately but you are correct that being US only.
