The 360 does not have better graphics then the PS3. If you look at a a game that is on both consoles, you'll that that there is pretty much no difference at all. Right now the graphics look the samwe on both consoles. If there are differences, they're minor at best. Oblivion does not look better than the 360 verios at all. In fact, most people think the the PS3 version looks better, which is also not true. In order to find the differeces between the graphics, you would need to looks at screenshot, stare at them for hours, then see a minor difference.
Other examples are in games such as Madden 08, the 360 version and PS3 verion look identical, but the 360 version runs at 60fps, while the PS3 version at 30. One other example ive noticed is the game Fear, the PS3 version has washed-out visuals and a stuttering frame rate, while the 360 version doesnt.
Like you said, the graphics in 08 are identical on each console. Having 60fps does not equate to having better graphics. F.E.A.R is hardly a game worth comparing, as it didn't look good on neither console. Again, better framerate does not equate to having better graphics.
All these differences are no result though of differences in power though, its mainly because developers have been making games for the 360 for over one and a half years, while they are still getting familiar with the PS3 hardware, which has been out for less time. So yes, at the moment the 360 generally has better graphics, but barely, and soon enough the PS3 will probably overtake the 360 (marginally though)
I really don't see how the 360 has better graphics then the PS3 right now. Something so petty like an extra tree, for instence, doesn't make the overall graphics better then the other console. Also, keep in mind that alot of the screen shots that have been compared have been played on different TV's with different brightness settings and such. I would bet any amount of money that if you played the same game on eatch console, you'll see that the graphics are, for the most part, the same.
