Its quite hard to patent/protect a lot of this stuff - as much of it has been done before to death (can Blizzard protect the concept of a MMORPG? No - but they can protect the brand name 'World of Warcraft' - which is what sucks most people in anyway).

and just for the record sony has said their gonna have a gamercard system of their own later this year so it wouldnt be surprising if UTIII is one of the first games to use sony's version of their gamercard

There is a spectrum of inventions ... On one end you have the obvious extention of what has come before and on the other end you have unconventional ideas which few would ever come up with ...

Very few ideas ever end up being really "Stealable" because they're easy to anticipate before the fact and are obviously valueable the second they're measured. These really should not need much protection because in protecting them you prevent competition ...

Nintendo had analog sticks first. Sony actually redesigned their PS1 controllers after launch to put analog sticks on them once they saw it succeed on the N64.
